IMPLIKASI PUTUSAN MAHKAMAH KONSTITUSI TERHADAP PROSES PEMBENTUKAN PERATURAN PERUNDANG-UNDANGAN DI INDONESIA

Abstract

This research is entitled Implications of Constitutional Court Decisions on the Process of Forming Legislation in Indonesia, which seeks to study and research the implementation of Constitutional Court decisions by law makers. This research is a type of normative research using a statutory approach and a conceptual approach. The decision of the Constitutional Court, which is the soul of the constitution which is final and binding at the level of implementation, still poses problems both juridically, philosophically and theoretically. This problem is because the decision of the constitutional court was not implemented either in part or in whole by the legislators in forming the law. Ignoring the decision of the Constitutional Court is the same as ignoring the constitution itself.
